1. Acceptance of Terms

By accessing and using the MPI Fabrication website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services Description

MPI Fabrication provides precision metal fabrication services including:

  • Commercial roofing fabrication (trim, coping, fascia, gutters, flashings)
  • HVAC ductwork and metal components
  • Custom sheet metal fabrication
  • Specialty metal components
  • Laser cutting and welding services

Important: MPI Fabrication provides fabrication services only. We do not provide installation services.

3. Quote Requests and Orders

Quote Process

When you submit a quote request:

  • You must provide accurate and complete project specifications
  • Quotes are estimates and may be subject to adjustment based on final specifications
  • Quotes are valid for 30 days unless otherwise stated
  • We reserve the right to refuse service for any reason

Order Acceptance

An order is accepted only when we provide written confirmation. All orders are subject to our acceptance. We may refuse or cancel orders at our discretion.

4. Customer Responsibilities

As a customer, you are responsible for:

  • Providing accurate, complete, and detailed specifications
  • Supplying clear drawings, CAD files, or technical documentation
  • Verifying dimensions, materials, and specifications before approval
  • Inspecting fabricated items upon receipt and reporting defects promptly
  • Ensuring proper installation (as we do not provide installation services)
  • Complying with all applicable building codes and regulations

5. Pricing and Payment

Payment terms:

  • Prices are subject to change without notice
  • Payment terms will be specified in your quote or invoice
  • Deposits may be required for custom fabrication projects
  • Late payments may incur interest charges
  • We reserve the right to suspend or cancel services for non-payment

6. Specifications and Changes

Customer-Provided Specifications: You are responsible for the accuracy of all specifications, drawings, and designs provided to us. We fabricate according to your specifications.

Changes: Any changes to approved specifications may result in additional charges and delays. Change requests must be submitted in writing.

Final Approval: You are responsible for final approval of specifications before fabrication begins. Once fabrication has started, changes may not be possible.

7. Tolerances and Quality

MPI Fabrication maintains industry-standard tolerances (±0.005" on precision work). Specific tolerance requirements must be clearly stated in project specifications. We adhere to ISO quality management standards and conduct quality inspections throughout the fabrication process.

8. Delivery and Lead Times

Delivery and lead times:

  • Standard turnaround is 24-72 hours for most projects
  • Lead times are estimates and not guaranteed
  • Delays may occur due to material availability or unforeseen circumstances
  • Rush services are available for an additional fee
  • Delivery terms and responsibilities will be specified in your order

9. Warranties and Disclaimers

Limited Warranty

We warrant that our fabrication work will be free from defects in materials and workmanship for a period of 30 days from delivery. This warranty does not cover:

  • Defects resulting from customer-provided specifications
  • Normal wear and tear
  • Improper installation (as we do not install)
  • Modifications made after delivery
  • Damage during shipping or handling by third parties

Disclaimer

EXCEPT AS EXPRESSLY STATED ABOVE, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. We are not responsible for the suitability of fabricated items for your intended application or compliance with building codes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC FABRICATION SERVICES THAT GAVE RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, OR PROJECT DELAYS.

11. Intellectual Property

Customer Designs: You retain all rights to designs, drawings, and specifications you provide to us. We will not reproduce or use your designs for other customers without permission.

Website Content: All content on our website, including text, graphics, logos, and images, is owned by MPI Fabrication and protected by copyright and trademark laws.

12. Confidentiality

We treat project specifications, drawings, and business information as confidential and will not disclose them to third parties without your consent, except as required by law or necessary to fulfill services.

13. Cancellations and Returns

Cancellations: Orders may be cancelled before fabrication begins. Once fabrication has started, custom orders cannot be cancelled.

Returns: Custom fabricated items are generally non-returnable. Defective items covered under warranty will be repaired or replaced at our discretion.

14. Force Majeure

We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, acts of government, labor disputes, material shortages, or other force majeure events.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Chatham County, Georgia.

16. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
